DRAFTMAN, LLC Privacy Notice

At DRAFTMAN, LLC (“we,” or “us”), we value the privacy of individuals who use our websites and related services (collectively, our “Services”). Ownership Restriction/Legal Disclaimer for Detailed Drawings

I. Ownership

  1. The copyright in all drawings, plans, elevations, sections, details, and designs (hereinafter “Detailed Drawings”) prepared by any client, contractor, previous employer, or DRAFTMAN, LLC is owned and copywritten by each client, contractor, employer, or DRAFTMAN, LLC as applicable.
  2. The Detailed Drawings are protected by copyright law and are considered original artistic works, requiring some element of expressive or creative choice in their production.

II. Restrictions on Use

  1. The Detailed Drawings may only be used for the specific project or development      for which they were prepared, as specified in the planning permission or approval.
  2. Any person or entity seeking to use The Detailed Drawings must obtain a license from DRAFTMAN, LLC and any client, contractor, or previous employer, as applicable.
  3. The license shall not be assignable without the prior written consent of DRAFTMAN, LLC and any client, contractor, or previous employer.
  4. The license granted shall specify the permitted uses, including but not  limited to:
    • Development and construction of the project
    • Marketing and advertising purposes
    • Public display and exhibition
    • Any other use deemed necessary by DRAFTMAN, LLC and any client, contractor, or previous employer

III. Permitted Uses

  1. Any use not specifically permitted by this Legal Note or the license granted      requires prior written approval from DRAFTMAN, LLC and any client, contractor, or previous employer.
  2. The following uses are permitted without a license:
    • Viewing and downloading The Detailed Drawings for informational purposes only
    • Commenting on The Detailed Drawings during the consultation period for planning applications
    • Comparing The Detailed Drawings with earlier applications or checking compliance  with planning permission

IV. Infringement

  1. Any unauthorized use, reproduction, or distribution of The Detailed Drawings      constitutes copyright infringement and may result in legal action.
  2. DRAFTMAN, LLC and any client, contractor, or previous employer reserves the right to seek damages, injunctive relief, and other remedies for any infringement.
  3. Any non-licensed Detailed Drawings .dwg file format may not be copied,      reproduced, modified, or distributed without the express permission of DRAFTMAN, LLC and any client, contractor, or previous employer.
  4. Any non-licensed Portable Document Format (.pdf) of Detailed Drawings may not      be copied, reproduced, modified, or distributed without the express permission of DRAFTMAN, LLC and any client, contractor, or previous employer. This includes but is not limited to the utilization of the AutoCAD PDFIMPORT command, the BricsCAD PDFIMPORT command, or any 3rd party program to import or recreate any Detailed Drawings of DRAFTMAN, LLC and any client, contractor, or previous employer.

V. Disclaimer

  1. The Detailed Drawings are provided “as is” and without warranty or representation as to their accuracy, completeness, or fitness for a      particular purpose.
  2. DRAFTMAN, LLC is NOT A PROFESSIONAL ENGINEER FIRM. Its owners and employees are NOT PROFESSIONAL ENGINEERS and cannot provide stamped and sealed Construction Documents. Consult the properly disciplined Professional Engineer for stamped and sealed documents.
  3. DRAFTMAN, LLC shall in no way be held responsible and declaim any liability for direct, indirect, or consequential loss or damage incurred as a result from any construction defects, increased budgets, or construction lawsuits.

VI. Governing Law

  1. This Legal Note shall be governed by and construed in accordance with the laws of each State/Country the project was performed in.
  2. Any disputes arising from this Legal Note shall be resolved through [mediation/arbitration/litigation] in accordance with [applicable rules and procedures].
  3. Some items blurred/covered or deleted per Calfiornia Mediation/Settlement Communications Evidence Code Sections 1119 and 1152, Oregon OEC 408, Hawaii Rule of Evidence Rule 408.  No items shown on draftman.us or any affiliated sites show any communications, negotiations, or settlement discussions that occured during course of project.

VII. Amendments

  1. This Legal Note may be amended or updated by DRAFTMAN, LLC and any client, contractor, or previous employer at any time without notice.
  2. The revised Legal Note shall be effective upon publication on the website or other designated platform.

Effective Date: 02/01/2025

By accessing or using The Detailed Drawings, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Legal Note.
